Terms of Service

These Terms of Service govern your use of the EmailQo platform operated by EmailQo. By creating an account or using EmailQo, you agree to be bound by these Terms. If you do not agree, do not use our service.

1. The Service

•EmailQo provides an email outreach platform including campaign management, email warmup, deliverability tools, and AI-powered features.

•We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

•We may update these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.

2. Account Registration

•You must be at least 18 years old and have the legal authority to enter into these Terms.

•You must provide accurate and complete information during registration.

•You are responsible for maintaining the security of your account credentials.

•You must not share your account with others or allow unauthorised access.

•You are responsible for all activity that occurs under your account.

3. Acceptable Use

•You may only use EmailQo for lawful outreach purposes.

•You must comply with all applicable anti-spam laws including CAN-SPAM, GDPR, CASL, and any other laws applicable to your jurisdiction.

•You must include a functioning unsubscribe mechanism in all marketing emails.

•You must honour unsubscribe requests promptly.

•You must not send emails to purchased lists without proper consent where required by law.

•You must not use EmailQo to send spam, phishing emails, malware, or any content that is illegal, harmful, or deceptive.

•You must not use EmailQo to harass, threaten, or abuse recipients.

•You must not misrepresent your identity or impersonate others in your email campaigns.

4. Prohibited Activities

•Sending unsolicited bulk email to recipients who have not opted in.

•Sending emails promoting illegal products or services.

•Harvesting or scraping email addresses without permission.

•Using the platform to conduct phishing or social engineering attacks.

•Attempting to bypass any rate limits, security measures, or platform restrictions.

•Reverse engineering or attempting to extract source code from the platform.

•Reselling or sublicensing access to the platform without written permission.

•Using the platform in any way that could damage our reputation or infrastructure.

5. Your Content and Data

•You retain ownership of all contact data, email content, and campaign materials you create or upload.

•By using the platform, you grant us a limited licence to process your content solely to provide the service.

•You are solely responsible for ensuring your email campaigns comply with applicable laws.

•We are not responsible for the content of emails you send using the platform.

•We reserve the right to review and remove content that violates these Terms.

6. Intellectual Property

•EmailQo and all related logos, trademarks, software, code, designs, and content are the exclusive property of EmailQo.

•Nothing in these Terms transfers any intellectual property rights to you.

•You may not copy, reproduce, modify, distribute, or create derivative works from any part of the platform without our prior written consent.

•Your feedback, suggestions, or ideas submitted to us may be used by EmailQo without any obligation to compensate you.

7. Subscriptions and Billing

•EmailQo offers a 7-day free trial with full access to all features. No credit card is required for the trial.

•After the trial period, continued use requires a paid subscription.

•Subscriptions are billed monthly or annually in advance.

•All payments are processed by Dodo Payments. By subscribing you agree to their payment terms.

•Subscription fees are non-refundable except as stated in our Refund Policy (Section 8).

•We reserve the right to change pricing with 30 days notice. Price changes take effect at your next billing cycle.

•Failed payments may result in service suspension. We will notify you by email before suspending your account.

8. Refund Policy

•If you are not satisfied with your paid plan within the first 7 days of subscribing, contact us at billing@emailqo.com for a full refund.

•After 7 days, subscriptions are non-refundable.

•Annual subscriptions cancelled after 7 days will not be refunded but you will retain access until the end of the billing period.

•Refunds are processed within 5 to 10 business days.

9. Service Availability

•We aim to maintain 99.9% uptime but do not guarantee uninterrupted service.

•We may perform scheduled maintenance with advance notice where possible.

•We are not liable for losses resulting from service downtime, delays, or interruptions.

10. Account Suspension and Termination

•We may suspend or terminate your account immediately if you violate these Terms.

•We may suspend accounts that generate excessive bounce rates, spam complaints, or other deliverability issues.

•You may cancel your account at any time from account settings or by emailing hello@emailqo.com.

•Upon termination, your access to the platform will cease. Your data will be deleted within 30 days.

•We are not liable for any losses resulting from account suspension or termination due to Terms violations.

11. Limitation of Liability

•EmailQo is provided on an as-is and as-available basis without warranties of any kind.

•We do not guarantee that our service will meet your specific business objectives or generate any particular results.

•To the maximum extent permitted by law, EmailQo shall not be liable for any indirect, incidental, special, or consequential damages.

•Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

•We are not responsible for the actions of third-party email providers, ISPs, or email clients.

12. Indemnification

•You agree to indemnify and hold harmless EmailQo from any claims, damages, or expenses arising from your use of the platform.

•This includes claims arising from your email campaigns, your violation of these Terms, or your violation of any third-party rights.

13. Force Majeure

•EmailQo shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.

•This includes but is not limited to acts of God, natural disasters, war, terrorism, internet outages, third-party service failures (including AWS, Supabase, or Vercel), government actions, or any other event outside our reasonable control.

•In such events, our obligations are suspended for the duration of the force majeure event.

14. Dispute Resolution

•In the event of a dispute, both parties agree to first attempt resolution through good faith negotiation for a period of 30 days.

•If negotiation fails, disputes shall be resolved through binding arbitration in India before resorting to litigation.

•Class action lawsuits against EmailQo are expressly waived to the fullest extent permitted by law.

•Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

15. Severability

•If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable.

•The remaining provisions of these Terms shall continue in full force and effect.

16. Entire Agreement

•These Terms, together with our Privacy Policy, constitute the entire agreement between you and EmailQo with respect to your use of the platform.

•These Terms supersede all prior agreements, representations, and understandings between you and EmailQo, whether written or oral.

•No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

17. Governing Law

•These Terms are governed by the laws of India.

•Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts of India.

•We will make reasonable efforts to resolve disputes amicably before pursuing legal action.
